1. About Us

Deltrade Catering, Events & Services is a catering and events company registered and operating in Ghana, with our primary base in Cape Coast, Central Region. We provide food catering, event planning and management, food delivery, and related hospitality services to individuals and organisations across Ghana.

2. Definitions

• “We”, “Us”, “Our” refers to Deltrade Catering, Events & Services.
• “You”, “User”, “Customer” refers to anyone who visits, registers on, or places an order through our website.
• “Services” means all catering, events, food delivery, and related services we provide.
• “Order” means a food order placed through our website or any other channel.
• “Booking” means a reservation for event catering or event management services.
• “Platform” means our website at deltradecateringandevent.com and any associated mobile interfaces.

3. Eligibility

By using our Platform, you confirm that you are at least 18 years of age or are accessing the Platform under the supervision of a parent or legal guardian. You must be capable of entering into a legally binding contract under Ghanaian law.

4. Account Registration

• You may be required to create an account to place orders or book services. You agree to provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, or violate these Terms.
• You may not create an account on behalf of another person without their express authorisation.

5. Our Services

We offer the following services through our Platform and directly:

• Food Ordering & Delivery: Online ordering of food items from our menu for delivery to your specified address within our service area.
• Event Catering: Full catering packages for weddings, corporate events, birthday celebrations, funerals, and other social gatherings.
• Event Planning & Management: End-to-end event coordination, decoration, logistics, and staffing support.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice. Pricing, menu items, and availability may change without notice.

6. Orders and Payments

• All orders placed through our Platform are subject to acceptance and availability. We reserve the right to decline or cancel any order at our discretion.
• Prices displayed are in Ghana Cedis (GHS) and include applicable taxes unless otherwise stated. Delivery fees are shown separately at checkout.
• Payment is processed securely through Paystack. We accept mobile money, debit/credit cards, and other payment methods supported by Paystack.
• Your order is confirmed only after successful payment verification. You will receive a confirmation via email and/or SMS.
• For event bookings, a deposit may be required to secure your date. The remaining balance is due by the date agreed in your booking confirmation.
• We are not responsible for payment failures caused by your bank, network provider, or payment processor. Please contact us if you experience payment issues.

7. Delivery

• Delivery is available within our designated service areas. Delivery fees and estimated times are shown at checkout.
• Delivery times are estimates only and may be affected by traffic, weather, distance, or high order volumes. We are not liable for delays outside our reasonable control.
• You must provide a complete and accurate delivery address. We are not responsible for failed deliveries due to incorrect address information.
• You or an authorised representative must be available to receive the delivery. A delivery confirmation code will be sent to you to verify receipt.
• If delivery cannot be completed due to your unavailability, additional charges may apply for re-delivery.

8. Cancellations and Refunds

Food Orders

• You may cancel a food order only before it has been accepted and preparation has begun. Once preparation starts, cancellation is not possible.
• If we are unable to fulfil your order for any reason, a full refund will be issued to your original payment method within 5–10 business days.

Event Bookings

• Cancellations made more than 14 days before the event date are eligible for a full refund of any deposit paid, minus any non-recoverable costs already incurred.
• Cancellations made within 7–14 days of the event date will forfeit 50% of the deposit.
• Cancellations made within 7 days of the event date will forfeit the full deposit.
• We reserve the right to cancel bookings due to circumstances beyond our control (e.g. force majeure). In such cases, a full refund will be provided.

9. Food Safety and Allergens

• We take food safety seriously and comply with applicable Ghanaian food safety standards and regulations.
• Our food may contain or come into contact with common allergens including nuts, gluten, dairy, eggs, fish, and shellfish.
• If you have a food allergy or dietary requirement, you must inform us at the time of ordering. We will do our best to accommodate your needs but cannot guarantee a fully allergen-free environment.
• We are not liable for any allergic reaction or health issue arising from failure to disclose known allergies.

10. User Conduct

When using our Platform, you agree not to:

• Provide false, misleading, or fraudulent information.
• Use the Platform for any unlawful purpose or in violation of any applicable Ghanaian law.
• Attempt to gain unauthorised access to our systems, accounts, or data.
• Post or transmit harmful, offensive, or defamatory content.
• Use automated tools, bots, or scripts to scrape, crawl, or interact with the Platform.
• Engage in any conduct that disrupts or interferes with the normal operation of our services.

Violation of these rules may result in immediate account suspension and legal action where appropriate.

11. Intellectual Property

All content on this Platform — including but not limited to text, images, logos, graphics, menus, and software — is the property of Deltrade Catering, Events & Services or its licensors and is protected by applicable copyright and intellectual property laws in Ghana and internationally.

You may not reproduce, distribute, modify, or use any of our content for commercial purposes without our prior written consent.

12. Privacy and Data Protection

We collect and process your personal data in accordance with Ghana's Data Protection Act, 2012 (Act 843). By using our Platform, you consent to our collection and use of your data as described in our Privacy Policy.

We will never sell your personal data to third parties. Your data is used solely to provide and improve our services, process orders, and communicate with you.

13. Loyalty Programme

We operate a loyalty points programme for registered users. Points are earned on qualifying purchases and may be redeemed for discounts or rewards as described on our Platform. We reserve the right to modify, suspend, or terminate the loyalty programme at any time. Points have no cash value and are non-transferable.

14. Disclaimer of Warranties

Our Platform and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by Ghanaian law, we make no warranties, express or implied, regarding the reliability, accuracy, availability, or fitness for a particular purpose of our Services.

We do not warrant that the Platform will be error-free, uninterrupted, or free from viruses or other harmful components.

15. Limitation of Liability

To the maximum extent permitted by law, Deltrade Catering, Events & Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of profit, loss of data, or loss of goodwill.

Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount you paid to us for the specific order or service giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under Ghanaian law.

16. Indemnification

You agree to indemnify and hold harmless Deltrade Catering, Events & Services, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our Platform, your violation of these Terms, or your infringement of any third-party rights.

17. Third-Party Links and Services

Our Platform may contain links to third-party websites or services (such as our payment processor, Paystack). We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of God, fire, flood, strikes, civil unrest, government action, power outages, or any other event beyond our control.

19. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any dispute arising out of or in connection with these Terms shall first be referred to mediation between the parties in good faith.

If mediation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Ghana. You agree to submit to the personal jurisdiction of the courts located in Ghana for the purpose of litigating any such claim.

20. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Where changes are material, we will notify registered users by email or a notice on our Platform. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
